The “Lunch Break” Violation: Why Ohio Restaurants Need More Than One PIC

Every General Manager knows the rule: Ohio requires every food service operation to have at least one person with Level 1 Food Safety Certification (Person-in-Charge) present during all hours of operation.

But here is the scenario that catches restaurants off guard: It’s 2:00 PM. The lunch rush is over. The certified General Manager runs to the bank to make a deposit. At 2:10 PM, the Health Inspector walks in.

They ask the Shift Lead: “Who is the Person in Charge right now?” If that Shift Lead doesn’t have their Level 1 certification, you are technically in violation of Ohio Uniform Food Safety Code.

Ohio Person in Charge CertificationThe “One Manager” Risk Relying on a single certified manager is a risky strategy.

  • What if they get sick?

  • What if they go on vacation?

  • What if they quit without notice?

If your “certificate holder” isn’t in the building, your compliance just walked out the door with them.

The Solution: Certify Your Shift Leads The smartest operators don’t just certify the GM; they certify every Key Holder and Shift Lead. Why? Because redundancy is insurance.

For just $15, you can have your Shift Leads take the ACE Food Handler Level 1 course online. It takes less than 2 hours.

  • No Classes: They can do it on their phone between shifts.

  • Instant Proof: They get a digital certificate immediately.

  • Total Coverage: You never have to worry about who is “in charge” when the GM steps away.

Don’t wait for an inspection to realize you are understaffed on safety. Build your “bench strength” today.

Frequently Asked Questions (Ohio PIC)

How many “Persons in Charge” does a restaurant need? Ohio law requires at least one Person in Charge (PIC) with Level 1 certification to be present during all hours of operation. If your only PIC leaves the building, you are non-compliant. We recommend certifying all Shift Leads to ensure full coverage.

Does the Ohio Level 1 certificate expire? The state does not set a mandatory expiration date for Level 1 certification. However, if a certificate is lost or damaged, you must retake the course to obtain a new one, as replacement records for very old certificates are often unavailable.

Is this course approved by the Ohio Department of Health? Yes. ACE Food Handler is an officially approved provider for Ohio Level 1 Certification in Food Protection. The certificate is valid statewide.
